Terms and Conditions
All contracts of sale made by the company shall be deemed to incorporate these terms and conditions which shall prevail over any other document or communication with the party with whom the company is dealing (the customer).
STANDARD FREIGHT DELIVERY SERVICE
Furniture items are often larger and / or heavier than Fed Ex and similar shippers will accept. Therefore many items on this site are shipped by a freight carrier.
Those items that are shipped to you directly from their factory in Europe, will travel by air freight and then by ground - motor freight. Shippers generally deliver on week days during working hours - so
IT IS YOUR RESPONSIBILITY TO ARRANGE TO MEET THE SHIPPER AT THE DELIVERY ADDRESS AT THE APPROPRIATE TIME. PLEASE NOTE YOU WILL NOT RECEIVE A CALL FROM THE SHIPPER ADVISING OR REMINDING YOU OF THE DELIVERY TIME. IT IS YOUR RESPONSIBILITY TO TRACK THE SHIPMENT USING THE TRACKING NUMBERS THAT WE PROVIDE TO YOU. Many of the delivery services that we use have a useful shipping locator/tracking system on their OWN web sites.
Shipments come professionally packed, often in crates, and / or reinforced boxes. These are likely to require simple tools to open, including but not limited to: box and wire cutters - and a tool for removing nails from wood, (commonly found on the back of a hammer).
PLEASE NOTE THAT YOU WILL BE RESPONSIBLE FOR OPENING AND DISPOSING OF THE PACKING MATERIALS. THE SHIPPER WILL NOT OPEN THEM FOR YOU, AND WILL NOT TAKE THEM AWAY.
Some product may require assembly e.g. many tables ship with legs separate.
WHEN USING THIS STANDARD SERVICE - PLEASE NOTE THAT YOU WILL BE RESPONSIBLE FOR ASSEMBLY. SHIPPERS WILL NOT HELP WITH ASSEMBLY.
PLEASE NOTE THAT ALL STANDARD DELIVERIES ARE - CURB SIDE DROP OFF. However depending on the ease of access to your home or garage - shippers may at their own discretion bring items inside for you.
NOTE: Delivery is generally undertaken by one person - and as such items weighing more than 100lbs, and / or items that are of an awkward shape, (difficult to lift), will require that you make arrangement for them to be brought into your home, by someone other than the delivery agent.
NO ADDITIONAL EQUIPMENT, SKILLS OR MANPOWER IS INCLUDED IN THE SHIPPING SERVICE. THE FURNITURE COLLECTION COMPANY shall not be responsible for the provision of services or costs incurred to overcome such obstacles.
PLEASE NOTE THAT SHIPPERS ARE IN NO WAY OBLIGED TO BRING ITEMS INSIDE FOR YOU.
WHITE GLOVE DELIVERY - AN ALTERNATIVE TO THE STANDARD DELIVERY SERVICE:
You may, for a fee, request that The Furniture Collection arrange for a White-Glove Delivery Service.
White Glove Service includes: Bringing the item into your premises, professional unpacking, and assembly.
With White Glove delivery service, you will be contacted directly by the delivery service...to arrange for a suitable weekday delivery - usually within a four to five hour time frame, between office hours - 8am to 5pm.
PLEASE NOTE THAT WHITE GLOVE SERVICES GENERALLY COST APPROXIMATELY 25 - 35% MORE THAN STANDARD FREIGHT SERVICES. ALSO PRICES QUOTED FOR WHITE GLOVE SERVICES ASSUME EASY ACCESS, THAT REQUIRES NO TOOLS OR MACHINERY NECESSARY TO BRING THE ITEM INTO YOUR HOME.
NO ADDITIONAL EQUIPMENT, SKILLS OR MANPOWER IS INCLUDED IN THE SHIPPING SERVICE.
IT IS YOUR RESPONSIBILITY TO MAKE CERTAIN THAT ITEMS PURCHASED WILL FIT THROUGH ACCESS ROUTES INTO YOUR HOME. IN THE EVENT THAT YOU MAKE A PURCHASE THAT CAN NOT BE DELIVERED, YOU WILL BE LIABLE FOR INBOUND AND RETURN SHIPPING, INSURANCE, CUSTOMS, (where applicable) PLUS (for in stock items) 30% RESTOCKING FEE OR IF THAT ITEM IS MADE TO ORDER, NO REFUND WILL BE AVAILABLE.
IMPORTANT NOTICE REGARDING UNDELIVERABLE PACKAGES:
In the event that you are unable to arrange for someone to meet the delivery agent, or fail to turn up accordingly...
UNDELIVERABLE PACKAGES WILL EITHER BE STORED LOCALLY AT THE EXPENSE OF THE PURCHASER, OR IF NO LOCAL STORAGE IS FOUND TO BE AVAILABLE - THEY MAY BE SHIPPED BACK TO THE SUPPLIER - IN THIS EVENT ALL APPLICABLE RETURN SHIPPING, INSURANCE, CUSTOMS AND RESTOCKING FEES WILL BE CHARGED TO THE PURCHASER - AS WILL ANY SUBSEQUENT REDELIVERY COSTS.
In the event that delivery is delayed or prevented by any untoward occurrence The Furniture Collection is not responsible or liable in any way whatsoever.
RETURNS due to material defects:
The Furniture Collection goes to great lengths to ensure the quality of the products coming out of our suppliers factories, and we are confident that you will be delighted with your purchases. However in the unlikely event that goods arrive damaged or that you chose to return undamaged goods, the following terms and conditions will apply.
All goods are warranted free of material defects. It is the responsibility of the purchaser to personally verify that the item(s) have been delivered in suitable condition.
PLEASE NOTE - WE STRONGLY ADVISE THAT YOU INSPECT THE GOODS WHILE THE DELIVERY SERVICE REPRESENTATIVE IS STILL PRESENT
If you are unable to inspect the goods while the representative is still present -please mark the freight bill as follows: - UNABLE TO INSPECT ON DELIVERY - AND PLEASE KEEP ALL PACKAGING MATERIALS UNTIL YOU HAVE HAD TIME TO INSPECT THE GOODS.
NOTE HOWEVER THAT FAILURE TO EXAMINE THE GOODS WHILE THE REPRESENTATIVE IS STILL PRESENT IS LIKELY TO MAKE SUBSEQUENT CLAIMS MORE COMPLEX AND POSSIBLY MORE DIFFICULT!
In the unlikely event that an item arrives damaged:
IF DAMAGE IS FOUND PLEASE DO NOT SIGN THE FREIGHT BILL, INSTEAD MARK IT - DAMAGED GOODS - PLEASE RETURN TO SENDER.
Simply ask the delivery service representative to return the item(s) to the supplier address.
CONTACT US IMMEDIATELY at 415-464-1154 orders@theFurnitureCollection.com to inform us of the situation, so that we can arrange for a replacement piece to be shipped to you as soon as possible.
ALL OF OUR SHIPMENTS ARE INSURED FOR THEIR FULL VALUE - THE PURCHASER WILL INCUR NO CHARGE FOR RETURNING DAMAGED GOODS IN THIS MANNER.
In the event that damage is not noticed while the delivery service representative is still present, the purchaser has TWO WORKING DAYS TO NOTIFY US OF A PROBLEM and inform us of their intention to return the item. Having notified us of this intention, the purchaser now has SEVEN DAYS (including weekend days) FOR RETURN SHIPPING OF THE ITEM.
REMEMBER THAT RETURNS MUST BE IN THEIR ORIGINAL PACKAGING
PLEASE NOTE: The goods must have been re-shipped from the customer within this 7 day period. We are unable to accept damaged returns which have not been shipped back within this period of grace.
In order to ascertain who is responsible we need to know whether the packaging as well as the product is affected.

2. The factory/warehouse must receive the item within 30 days of your initial delivery.
PLEASE NOTE: Items received after these time periods will not be accepted for return
RETURNS - Of Undamaged Goods - 30 Day Money Back Guarantee - FOR ALL INSTOCK ITEMS (excluding shipping and restocking fees). If for whatever personal reason you choose not to keep the merchandise - you may return it under the following conditions:
CUSTOM MADE GOODS ARE NOT RETURNABLE. No returns are possible for goods made to order.
Orders for CUSTOM MADE GOODS ARE NOT CANCEL-ABLE. No cancellations can be accepted for orders of goods made to order.
Orders for in stock items are cancel-able - up to, but not including the day that they are due to ship out from the warehouse. Cancellations of orders for in stock items will incur a CANCELLATION FEE of 10% PLUS credit card charges - where applicable, (usually 3 - 4%).
30% RESTOCKING FEE WILL BE CHARGED ON ALL RETURNS OF IN STOCK ITEMS.
PLEASE NOTE: Shipping and handling, insurance and customs fees are not refundable. FURTHER. THE PRICE OF MANY OF OUR ITEMS INCLUDES SOME SHIPPING COSTS BUILT IN - THESE COSTS WILL NOT BE REFUNDABLE, EVEN IF YOU WERE NOT EXPLICITLY CHARGED FOR SHIPPING OVER THE COST OF THE ITEM. THIS SPECIFICALLY INCLUDES PRODUCTS FOR WHICH SHIPPING IS DESCRIBED AS FREE.
3. The item(s) must be returned in the condition in which they were received - UNUSED AND COMPLETELY MERCHANTABLE. In the event that any damage is identified - please advise us before returning the goods.
6. Upon arrival of returned goods at the warehouses - items will be examined for merchantability. In the event that goods are deemed to have been damaged by the customer, the customer may be charged up to the full price of the item(s).

Property and Title:
The goods shall become the property of the Purchaser at the time it arrives at your front door. If delivery is prevented by difficult access, wrong information or, if the Purchaser wrongfully fails to arrange to receive the delivery as per, at the time when the Delivery Service has tendered delivery of the goods, ANY DAMAGE OR COSTS INCURED FOLLOWING DELIVERY OR ATTEMPTED DELIVERY - SHALL BE THE RESPONSIBILITY OF THE PURCHASER.
In the event that the delivery company is prevented from carrying out its obligations as a result of any cause beyond its control such as but not limited to Acts of God, War, Strikes, Lock-outs, Flood and Failure of third parties to deliver goods, The Furniture Collection Company and the delivery company shall be relieved of its obligations and liabilities for as long as such fulfillment is prevented. THE FURNITURE COLLECTION COMPANY IS AT NO TIME PROVIDING ANY WARRANTY OR ANY TYPE OF GUARANTEE THAT ANY PARTICULAR ITEM/MODEL OF PRODUCT OR ACCESSORY -ON THEIR WEB-SITE, IS SUITABLE OR USABLE FOR ANY PARTICULAR PURPOSE -WHETHER GENERAL OR SPECIFIC-WHATSOEVER..
Color differences and variations:
Please note that the colors shown in the online store may vary from product actual colors for the following reasons:
